IMPORTANT QUESTIONS FOR PROSPECTIVE TENANTS
What is the minimum term a property can be rented for?
David Cosby will provide assured shorthold tenancies for a minimum term of 6 months.
What fees / charges are applicable to taking a tenancy
HOLDING DEPOSIT:
If you wish to proceed after viewing a property, a holding deposit equivalent to one week’s rent is required while we carry out pre-tenancy checks. For example, referencing, affordability or credit checks. Once this holding deposit is paid, the property will be removed from our marketing campaign.
Your holding deposit will be refunded to you in full if the landlord decides not to rent to you. However, your holding deposit may not be returned if you:
- decide not to rent the property
- give wrong or misleading information
- cannot pass a ‘right to rent’ immigration check
COMPANY LETS:
We can facilitate Company Lets with a charge of £450 (including VAT) for the setup and arrangement of the tenancy agreement.
ADDITIONAL CHARGES:
Variation of Contract – £50 (including VAT) per agreed modification. This fee covers the expenses associated with obtaining landlords’ instructions, preparing, and executing new legal documents.
Change of Sharer – £50 (including VAT) per replacement tenant or any reasonable costs incurred, if higher. This fee includes the costs related to obtaining landlords’ instructions, conducting referencing and Right to Rent checks for the new tenant, registering the deposit, as well as the necessary preparations.
Early Termination – In the event that a tenant wishes to terminate their contract prematurely, they will be responsible for the landlords’ costs in reletting the property, as well as the rent due under the tenancy until the start date of the replacement tenancy. These costs will not exceed the maximum outstanding rent amount on the tenancy.
Unpaid Rent – Interest at a rate of 3% above the Bank of England Base Rate will be charged from the Rent Due Date until the outstanding rent is paid, to pursue non-payment of rent. This interest will only be applied if the rent is more than fourteen days overdue.
Lost Keys – Tenants are liable for the actual cost of replacing any lost key(s) or other security device(s). If the loss necessitates changing locks, the tenant will be responsible for the actual expenses incurred, including the locksmith’s fee, the cost of a new lock, and replacement keys for the tenant, landlord, and any other individuals requiring keys.
What documentation will I be required to produce?
David Cosby adheres to Government requirements and conducts Right to Rent checks for our tenants. To complete these checks, we ask tenants to provide necessary documentation such as a passport, birth certificate, driving license, or bank statement for proof of address. Please note that we cannot proceed with your application until we receive these documents.
For thorough referencing, we collaborate with an external company. They will request additional documentation related to your income, which you can upload directly onto their system. To validate your references, they may contact your current/previous landlord, employer, or request your most recent annual tax return document if you are self-employed. The referencing process typically takes 5-7 days, provided they receive all the required information and you will be notified upon the completion of all checks. However, please be aware that if you provide false or misleading information resulting in failed references, your holding deposit will not be refunded.
As part of your tenancy agreement, we strongly recommend obtaining Tenant Liability Insurance. We advise having the policy in place from the beginning of the tenancy and maintaining it throughout the term. For more information on this matter, we suggest seeking independent insurance advice or consulting one of our letting agents for assistance.
How much deposit will be required?
Prior to the commencement of the tenancy, a security deposit amounting to five weeks’ rent is mandatory (e.g., for a monthly rent of £1,000, the deposit would be £1,153). Deposits must be submitted via bank transfer and will be safeguarded under the Deposit Protection Service. The deposit will be refunded at the conclusion of the tenancy, contingent upon the property being in a satisfactory condition.
What Deposit Scheme does David Cosby use?
David Cosby is a member of the Deposit Protection Service (DPS), which was introduced by the Government in April 2007 for all assured shorthold tenancies in England and Wales. The purpose of this scheme is to ensure fair treatment of tenants at the end of a tenancy by imposing legal obligations, as outlined in the Housing Act 2004, to safeguard and protect your deposit.
When is the payment deadline for the first month's rent and deposit?
To confirm your tenancy you will be required to make the payment of one month’s rent, along with the tenancy deposit (minus the holding deposit already paid), via bank transfer no later than three days before the tenancy commencement date. Please note that we are unable to accept ordinary cheques, switch cards, or credit cards as payment methods. Following this initial payment, future rent payments should be made through a standing order. The standing order should be set up to debit your account two days prior to the rental payment date, ensuring that the funds are received on the rent due date.
Is it possible to renew my tenancy once the initial term has ended?
If your tenancy has been conducted satisfactorily and the landlord approves, you have the option to renew your tenancy for an additional fixed term or transition into a month-to-month statutory periodic tenancy.
What is included for my rental payments?
For the majority of our rental properties, the rent payment solely covers the rent itself. You will have the responsibility of covering all utility bills, council tax, telephone, broadband services, as well as your TV licence.
